Rajasthan High Court Imposes ₹10,000 Fine on State for Repeated Appeals in Pay Scale Case

Jaipur, October 8 (Udaipur Kiran) — The Rajasthan High Court has expressed strong displeasure over the state government for repeatedly filing appeals in a case that had already been settled earlier regarding an employee’s pay scale. The court dismissed the latest appeal and imposed a penalty of ₹10,000 on the Higher Education Department.

The division bench of Justice Avneesh Jhingan and Justice B.S. Sandhu passed the order while hearing the state government’s appeal. The court noted that the issue had been conclusively decided in 2013, and even the previous appeal against that order had been dismissed. Despite this, the department continued to file fresh appeals in the same matter.

Advocate Tarun Chaudhary informed the court that Kamal Singh Chaudhary was appointed as a teacher in the Higher Education Department in November 1985 and was regularised in July 1992. He had approached the single bench seeking salary benefits under the UGC pay scale from his initial date of appointment.

In 2013, the single bench directed the department to calculate his salary from the first appointment date as per UGC pay scales. The department’s subsequent appeal was dismissed by the division bench in January 2016. Later, the petitioner filed a contempt petition seeking compliance, after which the department implemented the pay scale from July 1, 1992.

The court had allowed the petitioner to file a separate petition for the period between 1985 and 1992. That plea was also decided in December 2023, reaffirming the 2013 order. Despite this, the department again challenged the ruling through another appeal, which the court dismissed with a ₹10,000 cost, criticizing the repetitive litigation.
