Chandigarh, September 7 (Udaipur Kiran) : Punjab BJP president Kailash Singh Dhillon has labeled the objections raised by the Aam Aadmi Party (AAP) regarding the appointment of Justice Ashwini Kumar Mishra as the full-time Chief Justice of the Punjab and Haryana High Court as inappropriate.
In a statement issued on Monday, Dhillon emphasized that the entire process of appointing the Chief Justice was conducted in accordance with the Constitution and the established procedures outlined in the Memorandum of Procedure. He urged the need to understand the facts rather than politicizing the issue.
Dhillon explained that following the recommendations of the Supreme Court Collegium, the views of the Punjab and Haryana governments were sought on August 10 as per the established protocol. He noted that while the Haryana government and the governors of both states had given their consent, the Punjab government failed to respond within the stipulated timeframe.
According to Dhillon, if the concerned government does not provide its opinion within the designated period, it is deemed as consent under the rules. Therefore, he argued, questioning the constitutional process at this stage is not reasonable.
He accused the Punjab government of delaying important government files, which he claimed is adversely affecting administrative and constitutional processes.
Dhillon stated that unnecessary delays in matters related to the judiciary are not in the interest of effective institutional functioning. He asserted that respecting the independence of the judiciary and the constitutional process is the responsibility of every government. He condemned the Punjab Chief Minister and other ministers for questioning the judiciary’s independence, urging the Punjab government to honor constitutional processes and established rules instead of creating political controversies.
