New Delhi, Mar 2 : The Supreme Court Wednesday agreed to hear a petition tomorrow, seeking order and or direction to register FIR against those political parties, which allegedly indulged in distribution of freebies to the voters, so as to influence them during elections. Advocate Varun Kumar Sinha, Wednesday mentioned the matter before a three-judge Bench of the Supreme Court, headed by the Chief Justice of India (CJI) Nuthalapati Venkata Ramana, and also comprising Justices A.S. Bopanna and Justice Hima Kohli, agreed for early hearing tomorrow. The petition was filed in the Supreme Court seeking direction to the Election Commission of India (ECI) to disqualify all candidates fielded by Congress, Samajwadi Party (SP) for the ongoing Uttar Pradesh polls and of Aam Aadmi Party (AAP) in Punjab for “inducing electors/ voters by making offer of gift, goods,money from public exchequer”. After the mentioning, the CJI said “we shall consider the matter for hearing tomorrow.” Petition filed in the Supreme Court sought FIR against these parties which have fielded candidates indulging these practices prohibited under RPA,1951, in Uttarkhand, Punjab, Goa and Manipur respectively for an offence committed under Section 123(1)(A) of Representation of People Act, “Forget about when the elections are over and all that. What will courts do, stop elections? Election bribing is taking place everywhere. We know that. It’s not for a particular state. You have to prove before a court of law,” the CJI observed. The plea, filed by Hindu Sena Vice President, Surjit Singh Yadav, before the Supreme Court, said he was aggrieved by the offer and promises made by the Congress, SP, Bahujan Samaj Party (BSP) and AAP in the ongoing assembly elections being held in five states. The PIL filed in the Supreme Court challenged the offer and promises made by political parties during Assembly elections of freebies to the voters and public, “if their government is voted to power”. “Disqualify all the members set up by the Indian National Congress, Samajwadi Party in the State of Uttar Pradesh and the candidates set up by the Aam Aadmi Party in the State of Punjab in the Assembly Election, 2022,” the petition filed before the Supreme Court said.
