Woman Advocate Alleges Surveillance and Conspiracy by a Specific Group
Udaipur, July 19: A civil court in Udaipur has rejected an application seeking an interim injunction against the operator of the AIR E-Library and others, citing insufficient grounds for granting such relief.
The application was filed by advocate Hem Kunwar Khangarot, whose chamber is located in the New Court complex. The petition named AIR Librarian Madhuri Suhalka, AIR Café and E-Library operator Vijay Kumar, library staff members Gayatri and Sapna, and the Bar Association through its executive committee as respondents.
According to the plea, the AIR Library, situated within the District and Sessions Court premises, was established for the convenience and benefit of advocates. The petitioner alleged that for several years, the librarian and staff had been involved in suspicious and unauthorised activities, including sharing information about advocates with a particular group, monitoring advocates’ movements, disrupting the study environment and creating obstacles in legal work.
The petition further alleged that information regarding advocates visiting the library was being passed on to specific individuals, legal books were not being supplied when required and certain advocates were subjected to restrictions and mental pressure. The petitioner also alleged that the respondents were indirectly involved in election-related activities and were influencing newly enrolled advocates.
CCTV Footage Sought in Court
During the hearing, counsel for the petitioner submitted that on May 5, a woman advocate was repeatedly interrupted while carrying out filing work on a computer in the e-library. It was argued that the entire incident had been captured on CCTV cameras installed at the premises.
The petitioner requested the court to direct the respondents to preserve and produce the CCTV footage of May 5 before the court.
Appearing on behalf of the Bar Association, President Jitendra Jain argued that the main suit related to defamation, whereas the relief sought through the interim application was different from the issues raised in the original case. He further contended that the petitioner was attempting to use the court as a means to collect evidence and requested dismissal of the application.
Court Finds No Grounds for Interim Relief
After hearing both sides, Presiding Officer Nikita Jain of the Civil Court (City North) observed that the AIR E-Library operator had submitted an affidavit stating that CCTV recordings are not stored for more than 20 days.
The court noted that, according to the affidavit, the CCTV footage of May 5 was no longer available. Finding no sufficient grounds to grant an interim temporary injunction, the court rejected the application after hearing the parties.
