TRAI publishes recommendations to promote innovative technologies through regulatory sandboxes

The Telecom Regulatory Authority of India (TRAI) has issued recommendations to “promote innovative technologies, services, use cases and business models through regulatory safeguards in the digital communications sector”.

To address this urgent need, the Department of Telecommunications (DoT) wrote to the Telecom Regulatory Authority of India in March 2023 to create a regulatory safe for new services, technologies and business models in the digital communications industry.

TRAI sought recommendations on this framework. On behalf of the US Department of State, TRAI published a Consultation Paper (CP) in June 2023 to solicit feedback from stakeholders.

The Regulatory Sandbox (RS) enables regular and real-time access to customer communication networks and resources. This was not possible using traditional laboratory or experimental testing methods. Specific and general exceptions in the regulations that apply only to RS testing are permitted for testing new ideas.

Regulators in many countries have created such frameworks. Providing such a live testing framework in India will encourage more entrepreneurs to develop solutions for the digital communications industry not only in India but globally.

Thereafter, the Central Government issued the following provisions, among others, in the Telecommunications Act, 2023, notified on December 24, 2023:

“The Central Government may, in a prescribed manner and for a specified period, establish one or more regulatory sandboxes to promote and encourage innovation and technological development in telecommunications.

DoT has also developed and established a “Spectrum Regulator Sandbox” (SRS) or “WiTe Zone (Wireless Test Zone)” to facilitate RandD and outdoor testing activities for new wireless communication technologies. We have also published guidelines. However, for operations, these instructions do not provide for connection to PSTN/Public Commercial Networks/Satellites for test/research and development (RandD) purposes.

This means that testing in the WiTe area does not allow exposing the product to a real network environment. In addition to offline/lab/WiTe area testing, you should also test your product in a real live network environment. Additionally, some products may require other types of regulatory exemptions in addition to spectrum exemptions to test against live network requirements.

Based on the references received from the DoT, feedback from stakeholders and the definition of the regulatory security box provided for in the Telecommunications Act 2023, the new products, services, processes and businesses will be introduced in a live test environment. The focus is on model testing. After receiving the special monitoring device, the authorities have formulated recommendations to make it available to a limited number of users for a certain period of time.

This recommendation provides an overview of all relevant components and provides a comprehensive framework for conducting safety box tests in the area of ​​digital communication. As part of the recommendations, the agency specified the objectives and limitations of the RS framework. The proposed RS framework for the digital communications sector includes the following: eligibility to take part in the RS exam, mandatory requirements that participants must meet, supporting documents required to prove eligibility, application, assessment and approval procedures; The authority and validity of waiving or changing the rules. are detailed. Period, license revocation procedure, reporting requirements, etc.

Any Indian company, partnership firm, private limited company or research institute that has conducted limited initial testing of its products/services/programs and meets all the conditions mentioned in the framework is eligible for the Regulatory Sandbox. You can register for the exam. Since RS testing is performed on a live network for a specific group of users, this framework takes network security and client protection into account.

Therefore, under the RS framework, applicants are required to submit, among other things, required regulatory exemptions, proposed risk mitigation measures, proposed consumer protection mechanisms and a clearly defined exit strategy as part of their application. . . There is a strict timeline for completing the application evaluation process to ensure the responsiveness of the government agencies involved.
