Prayagraj, May 1: The Allahabad High Court provided relief to Congress leader Rahul Gandhi on Friday by dismissing a petition seeking the registration of an FIR against him for his statement regarding a ‘fight against the Indian state.’
Justice Vikram D. Chauhan rejected the petition filed by Simran Gupta of the Hindu Shakti Dal, which claimed that Gandhi’s statement hurt national sentiments and constituted anti-national and treasonous remarks.
The case relates to a statement made by Rahul Gandhi during the inauguration of the new All India Congress Committee (AICC) headquarters in New Delhi last January, where he stated, “We are now fighting against the BJP, RSS, and the Indian state.”
The petitioner alleged that this was not merely political criticism but an attempt to destabilize the country and portray the Indian state as an opposing force.
Previously, a local court in Sambhal had also dismissed a plea seeking an FIR against Gandhi. Following that, a revision petition was also rejected, leading to the case being brought before the Allahabad High Court.
In his speech, Rahul Gandhi accused the BJP and the Rashtriya Swayamsevak Sangh (RSS) of taking control of the country’s institutions, asserting that Congress is fighting to protect the Constitution and the core spirit of India.
His remarks sparked political controversy at the time, with BJP leaders accusing him of undermining India’s sovereignty and constitutional framework. Former BJP president J.P. Nadda stated that Gandhi’s statement reveals the true mindset of Congress and reflects an ideological battle against the nation.
Additionally, a case was registered against Rahul Gandhi under sections 152 and 197(1)(d) of the Indian Penal Code at the Pan Bazar police station in Guwahati, Assam, alleging that his comments incited discontent against the state and posed a threat to national unity.
