Rajasthan High Court Orders Status Quo in Bhilwara Ancestral Land Dispute

Bhilwara, May 17 (Udaipur Kiran) – A family dispute over ancestral agricultural land in the Mandal area of Bhilwara has taken a legal turn after the Rajasthan High Court ordered all parties to maintain status quo on the disputed property.

According to the case details, widow Damyanti Tunayat, daughter of late Gajanand Tunayat, alleged that her brothers fraudulently obtained a relinquishment deed related to her share in the ancestral property.

She alleged that her brothers, Omprakash Tunayat and Suresh Chandra Tunayat, prepared forged documents and attempted to gain control over the entire agricultural land.

The complainant said she had earlier filed reports at Mandal Police Station and with the Bhilwara Superintendent of Police, but alleged that no action was taken. Following this, she moved applications before the Additional Chief Judicial Magistrate Court in Mandal under Section 156(3) and also filed a civil case in the Sessions Court, Bhilwara seeking cancellation of the relinquishment deed.

After her plea for permanent injunction was rejected by the Sessions Court, she approached the Rajasthan High Court in Jodhpur through an appeal.

The High Court has now directed all cultivators and concerned parties linked to the disputed land to maintain status quo until further orders. As per the court’s direction, no sale, transfer of possession or construction activity can be carried out on the land until the matter is finally decided.

Sources said the woman has claimed that the relinquishment deed was obtained through misleading information and deception. Legal experts believe that daughters have equal rights in ancestral property and such rights cannot be waived without free and informed consent.

The case has drawn significant attention in the region, with locals now awaiting the final court decision.
