District Magistrate Cancels Lease Issued Against Salary for Land Donated for School in Udaipur

Udaipur, October 7 (Udaipur Kiran): The District Magistrate and District Collector has cancelled a lease issued by a gram panchayat in lieu of salary for land that had been donated for construction of a school in Sisarma, Udaipur.

According to the case details, Lokesh Bharti, the then Principal of Government Senior Secondary School, Sisarma, filed a revision petition in the District Magistrate’s Court in 2022 against Sisarma resident Gaurishankar, son of Dalchand Nagda.

The petition stated that a lease was issued to the respondent on October 20, 2006, but it was not in accordance with the law. The disputed land in Sisarma had been donated for the construction of the school, while the lease was allegedly issued in lieu of salary.

Land Donated for School Construction

According to the case, the Labour Court had issued an order in 2004 for payment of salary. However, instead of making the salary payment, a lease was issued against the salary.

It was also stated that the land in question had been donated for the school by Khubhilal Nagda.

The case further referred to an FIR registered by the Anti-Corruption Bureau against the then Sarpanch and Deputy Sarpanch in connection with allegedly forged leases. FIR No. 33/2011 had been registered and a charge sheet had subsequently been filed.

Government’s Arguments

Senior advocate Kalpit Jain, along with his associates Dinesh Wasita and Anil Tailor, jointly represented the government in the case.

The government argued that the land had been donated by Khubhilal Nagda for construction of the school and that there was no legal provision under the Panchayati Raj Act for issuing a lease in lieu of salary.

The government further submitted that the disputed land, recorded as Araji No. 3302, was classified as Bilanaam Gair Kabij Kasht and recorded in the name of the state government. Therefore, the gram panchayat did not have the authority to issue a lease for the land.

The government sought cancellation of the lease issued on October 21, 2006.

Lease Cancelled After Hearing

After hearing arguments from both sides and examining the documents on record, District Magistrate Gaurav Agrawal ordered the cancellation of the lease.

The order brings the disputed lease issued for the school-donated land under the scrutiny of the district administration and cancels the panchayat-issued lease.
