Complaint Filed in December 2023

Special Public Prosecutor Shivraj Singh Rathore said the victim’s father lodged a complaint at Nimbahera Kotwali police station on December 28, 2023. He stated that he had come to Baroli Ghata with his family for labour work and was living in a makeshift hut.

According to the complaint, the father had gone to work on the day of the incident. When he returned in the evening, his minor daughter told him that she had gone to a guava orchard in the village at around 3 pm to eat guavas.

She alleged that Dinesh Gameti, son of Ramesh Gameti and a resident of the Mewatiyon Ki Jhopdi area in Baroli Ghata, caught her and took her to a nearby mustard field, where he sexually assaulted her. When she resisted, he threatened her. He later left her in the orchard and fled.

Based on the complaint, police registered a case and began an investigation. The accused was arrested, and a charge sheet was filed in court for kidnapping, rape and offences under the POCSO Act.

Court Examines 17 Witnesses and 30 Documents

During the trial, the prosecution presented statements from 17 witnesses, including the victim, her father, doctors, police personnel and individuals connected with school records.

The prosecution also submitted 30 documents, including the medical report, FIR, victim’s statements, site map, Forensic Science Laboratory (FSL) report and school records.

After hearing arguments from both sides and examining the evidence on record, the court found Dinesh Gameti guilty.

  • Section 363 of the Indian Penal Code: Five years of rigorous imprisonment and a fine of ₹20,000.
  • Section 366 of the Indian Penal Code: Five years of rigorous imprisonment and a fine of ₹20,000.
  • Sections 3/4(2) of the POCSO Act: 20 years of rigorous imprisonment and a fine of ₹4 lakh.
