New Delhi, February 16: The family of the victim in the Unnao rape case has approached the Delhi High Court, seeking an increase in the sentence of former legislator Kuldeep Singh Sengar, who was convicted in the case related to the alleged death of the victim’s father in police custody. The hearing on this matter is scheduled for February 19.
The lower court had sentenced Sengar to ten years in prison for culpable homicide not amounting to murder in connection with the victim’s father’s death, along with a fine of ₹10 lakh. The court stated that there could be no leniency in a case involving the death of the sole breadwinner of the family. However, the victim’s side argues that this sentence is not commensurate with the severity of the crime and should be increased.
Previously, Sengar had filed a bail petition in the High Court, which was rejected. He later approached the Supreme Court, which denied to hear the case on February 9, instructing the Delhi High Court to complete the hearing on Sengar’s matter within three months.
Sengar’s lawyer claimed in the Supreme Court that he has already served 9 years and 7 months of his 10-year sentence. However, the High Court denied bail. The Central Bureau of Investigation (CBI), represented by Solicitor General Tushar Mehta, stated that Sengar is serving a life sentence in the rape case.
It is important to note that the judicial processes concerning both the Unnao rape case and the victim’s father’s death in police custody are ongoing at different levels. The legal system in the country is said to uphold the rule of law, ensuring fair hearings even in cases involving dangerous terrorists and traitors, as was the case with Ajmal Kasab.
Sengar is also facing a separate case of rape, for which the High Court had granted bail, but the Supreme Court has stayed that decision and revoked the bail.
