Asaram Denied Relief by Gujarat High Court, Bail Extension Rejected

Gujarat High Court

Jodhpur, September 3 (Kiran News): Self-styled godman Asaram, who is serving a sentence in a rape case, has been denied interim bail extension by the Gujarat High Court. The court on Wednesday refused to extend his interim bail, though it has scheduled a joint hearing on September 22 for his appeal challenging the conviction in the Gujarat case along with his bail plea.

Earlier, the Rajasthan High Court had also denied Asaram’s request for an extension of interim bail in the Jodhpur case, directing him to surrender before Jodhpur Central Jail. He had been granted interim bail until August 29 but surrendered on August 30 at 11 a.m.

Following Rajasthan High Court’s orders, a medical board at Ahmedabad Civil Hospital examined Asaram’s health. The report was directly submitted to the High Court, which ruled that his health condition was not serious enough to justify further extension of interim bail. However, the court allowed him the use of a wheelchair, an assistant in jail, and medical check-ups at AIIMS Jodhpur if required.

Proceedings in Gujarat High Court

During Wednesday’s hearing, the Gujarat High Court noted that the Rajasthan High Court had not extended interim bail on merit. It observed that if Asaram had already challenged the Rajasthan High Court’s order in the Supreme Court, then the apex court’s decision should be awaited. The bench said it could not take a different view based on the same medical report.

Asaram’s counsel argued that the Civil Hospital medical board’s findings should be reconsidered, pointing out that reports under RTI suggested some medical records were not submitted properly. They claimed Asaram’s health was deteriorating. However, the victim’s lawyer countered, saying the Gujarat High Court should not review the Rajasthan High Court’s order and maintained that the latter had found no continuous decline in Asaram’s health.
