Udaipur, July 25: The District Consumer Disputes Redressal Commission has directed the operator of Kunwar Kalewa Restaurant in Udaipur to refund ₹270 collected as a cover charge, along with interest, and pay an additional ₹13,000 as compensation and litigation expenses within two months.
Customer Challenged Cover Charge
According to the complaint, Rajveer Singh, a resident of Housing Board, Rajsamand, filed a case through advocate Bhanwar Singh Chundawat against Aniruddh Pratap Singh Ranawat, the operator of Kunwar Kalewa Restaurant at Rajvilas, Shobhagpura Circle, Udaipur.
The complainant stated that he purchased packed food from the restaurant on May 8, 2025, under Bill No. 1052. After making the payment, he noticed that ₹270 had been added to the bill as a cover charge.
He claimed that the food was packed and no additional or special service had been provided by the restaurant. Therefore, he argued that the restaurant had no authority to levy the extra charge.
Legal Notice Sent Before Complaint
The complainant alleged that when he objected to the additional charge, the restaurant operator entered into an argument with him. A legal notice seeking a refund of the ₹270 was sent on May 15, 2025, but the amount was not returned.
The complaint sought a refund of the excess amount with interest, along with ₹50,000 as compensation for mental and physical harassment and ₹50,000 towards legal expenses.
Commission Awards Compensation
After hearing both parties, the District Consumer Disputes Redressal Commission, comprising Chairman Dharmendra Sharma and Member Vinod Kumar Kushwaha, directed the restaurant operator to refund the ₹270 along with 6% annual interest from the date of filing of the complaint until the date of payment.
The Commission also ordered the restaurant operator to pay ₹5,000 towards compensation for mental harassment, ₹5,000 as litigation expenses and ₹3,000 as advocate’s fee, taking the total additional amount payable to ₹13,000, within two months.
