Rajasthan High Court Rules Recovery of Previous Salary from Constables Shifting to Teaching or Other Services is Wrong
Jaipur, August 6 (Udaipur Kiran): The Rajasthan High Court has ruled that the recovery of previously paid salary from constables who are selected for teaching or other services after their appointment as constables is illegal and wrong. Along with this, the court has directed the authorities to return the amount of the previous salary recovered from the petitioners. A single bench of Justice Mahendra Kumar Goyal passed this order while hearing the petitions of Banwari Lal Jat and 20 others.
In the petitions, advocate RP Saini told the court that the petitioners were appointed as constables in the Rajasthan Police Service on October 4, 2010. Later, they participated in the senior teacher recruitment and were selected for the post of teacher on September 5, 2020. Before taking up the post of senior teacher in the Ajmer division, the police department recovered the salary paid to them earlier and then released them. Challenging this in the High Court, it was argued that the petitioners were moving from one government post to another on a senior pay scale. In such a situation, it is wrong and arbitrary to recover the salary of the previous service from them when they change their service. Therefore, the amount recovered as previous salary should be returned. Hearing the matter, the single bench has directed the return of the amount recovered from the petitioners.
