
Jaipur : Mohammed Javed, one of the accused in the Kanhaiya Lal murder case, has been granted bail by the High Court. Justice Pankaj Bhandari, while hearing the bail plea, stated that the NIA had only arrested the accused based on call details and had failed to prove the accused’s location. Additionally, no recovery has been made from the accused. Considering the long time he has spent in jail and the likely prolonged trial, the court granted bail.
Among the 11 accused, Javed is alleged to have conspired with Mohammed Riyaz Attari. After the NIA court rejected his bail plea on August 31, 2023, the accused filed a bail petition in the High Court.
Accused’s Lawyer Claims Javed Never Visited Kanhaiya’s Shop
During the bail hearing, Javed’s lawyer, Syed Saadat Ali, argued that the NIA claimed Javed had planned the murder of Kanhaiyalal while sitting at the Indiana T-stall, but the owner of the T-stall, Dharmendra Sahu, did not confirm Javed’s presence there on that day.
The NIA also claimed that Javed had conducted a recce of Kanhaiyalal’s shop and informed Riyaz, but CCTV footage from the shop proved that Javed had never visited the shop.
Syed Saadat Ali further argued that according to the NIA, Riyaz (the main accused) had received a call from Javed, but Javed had never called Riyaz. Riyaz’s number was not even saved in Javed’s mobile. He worked as a salesman at a bangle shop and received numerous customer calls throughout the day.
NIA’s Argument: Both Met at the T-stall
The NIA’s lawyer, TP Sharma, argued that all the accused involved in the Kanhaiya Lal murder case knew each other. They had all conspired together to murder Kanhaiyalal. The call details of the accused proved that they were in contact with each other over the phone.
He further stated that their witness, Jishan, had also confirmed that Riyaz and Javed had met at the T-stall before the incident. Additionally, the accused had also admitted this in their statements. The court expressed displeasure over the statements taken by the NIA. The court said that all the statements were written in English. Why were they not written in the language in which the accused gave their statements?
Another Accused Granted Bail Earlier
Earlier, in this case, another accused, Farhad Mohammed alias Babla, was granted bail by the NIA court on September 1, 2023. The NIA had filed an arms act case against Farhad. While granting bail, the court had said that the accused was only charged under the Arms Act. It cannot be decided at the bail stage whether a sword was recovered from him or whether the sword was sharp or blunt.
Brutal Murder of Kanhaiyalal
On June 28, 2022, Mohammed Riyaz Attari and Ghaus Mohammad brutally murdered Kanhaiyalal by slitting his throat. In the Kanhaiyalal murder case, the NIA had filed a chargesheet against 11 accused, including the main accused Ghaus Mohammad and Mohammed Riyaz Attari, along with Pakistan residents Salman and Abu Ibrahim, who were declared absconders. The NIA special court took cognizance on February 9, 2023, under charges of murder, terrorist activities, criminal conspiracy, and the Unlawful Activities (Prevention) Act (UAPA) and Arms Act.
